Trust Administration Attorney in Laguna Beach, CA

Being named successor trustee of a parent’s or spouse’s trust is a real responsibility. You owe duties to every beneficiary, the first required notice is due within 60 days, and if the trust holds a Laguna Beach home, an art collection or other unique property, valuing and managing it takes care. The Soto Law Group guides trustees through the work, most of which happens outside of court. If a court step becomes necessary, we bring it before the Orange County Superior Court, whose trust and probate calendar is currently at the Costa Mesa Justice Complex.

Your First Months as Successor Trustee

  1. Collect the paperwork. Find the original trust, every amendment, the pour-over will and the deeds, and order certified death certificates.
  2. Notify the family. Under Probate Code Section 16061.7, the beneficiaries and legal heirs must receive notice no later than 60 days after the trust becomes irrevocable. That notice opens a 120-day window for any trust contest, and those who receive it may request the trust’s terms.
  3. Secure the property. Keep insurance in force, protect the home and its contents, and open a trust bank account under its own tax ID number.
  4. Value the assets. Date-of-death appraisals of real estate, artwork and other valuable property set the new tax basis and support a fair division.
  5. Pay what is owed. Settle final bills and debts, and file the person’s last individual tax returns and any trust income tax returns.
  6. Account and distribute. Report to the beneficiaries and transfer the assets as the trust directs.

When the Trust Holds a Laguna Beach Home

While the beneficiaries decide whether to sell, rent or keep the house, someone has to cover property taxes, insurance and upkeep on a hillside home or a cottage near Main Beach. The trustee also has 150 days from the death to file a Change in Ownership Statement with the Orange County Assessor. Proposition 19 matters too: when a child inherits a parent’s home and does not move in as their primary residence, the property is generally reassessed, and a child who does move in receives only capped protection. If some beneficiaries want to keep a family vacation home and others want cash, the trust’s terms control, and the trustee must treat everyone impartially. We help you weigh those numbers before anyone signs a listing agreement or a deed.

Art, Furnishings and Other Personal Property

Personal property can be the hardest part of a trust to settle. Paintings, sculpture, jewelry and furniture may carry real value and meaning, yet trusts often say little about them. A trustee should inventory each item, get qualified appraisals for valuable pieces, and keep everything insured and secure until distribution. Where the trust or a signed list assigns specific items, the trustee follows it; otherwise the property must be divided fairly under the trust’s terms, which may mean splitting the pieces or selling some.

When You Need the Court's Help

Most trusts are settled privately, though certain problems have to go before a judge. A trustee may need the court to bring in an asset that was never transferred into the trust, or to give instructions when the trust’s language is unclear. A dissatisfied beneficiary can petition for an accounting or the trustee’s removal. We draft these petitions, and we answer them on your behalf when a beneficiary files one.

Timing, Accountings and Trustee Pay

Many trusts take 12 to 18 months; one made up mostly of cash may finish faster. A home sale or family disagreement can take longer. Unless an exception applies, beneficiaries are owed an accounting every year, at termination and whenever the trustee changes. Trustees may also receive reasonable compensation unless the trust provides otherwise.

Frequently Asked Questions About Trust Administration in Laguna Beach

Do I need court approval to sell the Laguna Beach house?

Usually not. Most living trusts give the successor trustee power to sell real estate without going to court. The sale still has to be handled prudently, at a fair price and in keeping with the trust’s terms.

How should I value my parent's art collection?

Hire a qualified appraiser for any piece of significant value. Values at the time of death matter for the beneficiaries’ taxes, and a written appraisal gives you a solid record if anyone later questions how the collection was divided.

Can I turn down the trustee role?

You can decline the role before you accept it, and the next successor named in the trust can take over. When none of the named successors can serve, a court appointment fills the vacancy.
